2008 "Fly Cutter---Ride Red" Official Contest Giveaway Rules
1. No purchase necessary to enter or win. All federal, state, local and municipal laws and regulations apply. Void where prohibited.
2. Eligibility: The six (6) Honda PowerSport Products valued up to $8,000.00 and the Honda VTX1300 motorcycle are eligible to all participants who are eighteen (18) years of age or older at the time of drawing, and possess a valid drivers license. All current employees or anyone employed during this promotion by Cutter Aviation and its affiliates, their immediate family members are not eligible to participate.
3. Contest Entry: The contest giveaway will begin at 12:00 AM (E.S.T.), October 1, 2007 and all entries must be received by Midnight (E.S.T), September 17, 2008. Entries will also be accepted during the 2008 NBAA Show in Orlando, Florida for the Honda VTX1300 motorcycle until the time of the drawing.
Official e ntries are awarded based on the following criteria:
1 entry for - 100 – 249 gallons of fuel purchased (per visit)
3 entries for - 250 – 499 gallons of fuel purchased (per visit)
6 entries for - 500 – 749 gallons of fuel purchased (per visit)
8 entries for - 750 – 999 gallons of fuel purchased (per visit)
11 entries for - 1,000 – 1,249 gallons of fuel purchased (per visit)
13 entries for - 1,250 – 1,499 gallons of fuel purchased (per visit)
16 entries for - 1,500 – 1,749 gallons of fuel purchased (per visit)
20 entries for - 1,750 – 1,999 gallons of fuel purchased (per visit)
25 entries for - 2,000 or more gallons of fuel purchased (per visit)
(Excludes all Military purchases)
Multiple purchases permitted. Entry is also permitted by mailing a handwritten, official USPS Postal Card containingparticipants name, address, flight department name, and contact phone number. Mail entries to: Cutter Aviation, 2008 Promotion, 1500 E. Industrial Blvd, Suite 100, McKinney, TX 75069. There are no other means of entry available other than those described in the official rules. No mechanical reproductions permitted. Only one entry per person per month via USPS Postal Card is permitted. Entries by means of software generated or other automated processes will be disregarded. Cutter Aviation will not be responsible for incomplete, lost, post-due, misdirected or illegible entries. Entry also permitted via internet using the Cutter Cube Calendar. A limited supply of Calendars exists and may not be available during the entire promotion.
4. Prize: A total of Seven (7) Grand Prize winners will be selected in one or more random drawings from among all eligible entries to be held at the 2008 NBAA Show in Orlando, Florida. Entries from all participating FBO locations will be combined into one container and the six (6) winners will be drawn individually. Grand Prizes: Six (6) Honda PowerSport Products valued up to $8,000.00 (Good towards purchasing a (1) Honda Power Sports product) and one (1) Honda VTX1300 motorcycle. One winner will be drawn from entries received during the 2008 NBAA Show in Orlando, Florida prior to the time of the drawing. The Grand Prize to be given from entries received at the 2008 NBAA in Orlando, Florida is a Honda VTX300 motorcycle. Odds of winning depend on the number of eligible entries received.
5. Winner Notification and Acceptance. The grand prize winners will be notified by telephone and/or U.S. Mail on or about October 10, 2008. Need not be present to win one of the six (6) Grand Prizes drawn from entries received at our participating FBO locations. You must be present at the drawing held during the 2008 NBAA Show in Orlando, Florida to win the Honda VTX1300 motorcycle. Return of prize notification as undeliverable may result in disqualification and an alternate grand prize winner may be selected. The grand prize winner may waive their right to receive grand prize. The grand prize is non-assignable and nontransferable. No substitutions are allowed. Cash will not be awarded in lieu of the stated grand prizes. The grand prize winner is solely responsible for reporting and payment of any federal, state, and local taxes and will receive a 1099 form. The grand prize winner shall be solely responsible for payment of title, license, insurance, and registration fees on their Honda Power Sports product. The grand prize winner may be required to complete an affidavit of eligibility, and a liability and publicity release which must be returned within five (5) business days of date of postmark. Failure to sign and return the affidavit or release within five (5) business days, or to comply with any term or condition of these official rules, may result in grand prize winner’s disqualification, the forfeiture of his or her interest in the grand prize, and the award of the prize to an alternate winner. Except where prohibited by law, participation in the contest giveaway constitutes entrant’s consent to the publication of his or her name and likeness in any media for any commercial or promotional purpose, without limitation or further compensation. For the grand prize winners list (available on or about October 20, 2008) send a self-addressed, stamped envelope to Cutter Aviation, Grand Prize Winners, 1500 E. Industrial Blvd, Suite 100 , McKinney, TX 75069 .
6. Participation: By participating, entrants agree to be bound by these Official Rules and the decisions of the judges. Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this contest giveaway as solely determined by the sponsor. Cutter reserves the right to change the rules without notification.
7. Limitations of Liability: By entering the contest giveaway, entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with the contest giveaway, or any prize awarded, shall be resolved individually without resort to any form of class action; (2) any claims, judgments and awards shall be limited to actual out of pocket costs incurred, including costs associated with entering the contest giveaway, but excluding attorney’s fees; (3) under no circumstances will any entrant be permitted to obtain any award for punitive, incidental or consequential damages, and entrant hereby waives all rights to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out of pocket expenses.
8. General Release: By entering the contest giveaway, contestants release Cutter Aviation, any other promotional sponsors, and each of their respective affiliated companies, directors, officers, employees, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the contest giveaway or with the acceptance, possession or use of the grand prize (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light).
9. Sponsor: The 2008 Honda Power product Contest Giveaway is sponsored by Cutter Aviation Phoenix, Inc., whose decisions regarding the selection of winners and all other aspects of the contest giveaway shall be final and binding in all respects. Sponsor will not be responsible for typographical, printing or other inadvertent errors in these official rules or in other materials relating to the contest giveaway. Choice of Law: By entering the contest giveaway, entrant agrees that any claim of dispute will be decided in accordance with the laws of the State of Arizona; Contestants further agree that all disputes will be settled by binding arbitration, in Phoenix, AZ. subject to the rules of the American Arbitration Association.
